Terms of Voluntary Donations

A donation is voluntary support for the organization’s activity. It is not payment for an educational program, community participation, or membership.

1. Recipient and general provisions

1.1. The recipient of a donation is NGO “HandS Lab” (full registered name: NON-GOVERNMENTAL ORGANIZATION “Human & Synthetic Lab”), EDRPOU code 46189265, registered office: Ukraine, 03035, Kyiv, 13 Vasylia Mytropolyta Lypkivskoho Street, email: [email protected] (the “Organization”).

1.2. This document is the Organization’s proposal on the procedure for accepting voluntary donations from individuals and legal entities (the “Donor”) and is not an offer to buy goods or services.

1.3. Online acceptance of donations on the website will start after a payment service is connected and bank details are published. Until then the way of transferring funds and the purpose of support are agreed separately through [email protected].

2. Nature of a donation

2.1. A donation is a voluntary gratuitous transfer of funds or other property in support of the Organization’s statutory activity (Article 717 of the Civil Code of Ukraine and the legislation on civic associations). The Donor receives nothing in return.

2.2. A donation is not payment for an educational program, community participation, access to a digital service, or a membership fee, and does not give a right to any of them.

2.3. If a payment is a condition of receiving a defined package of services, it is payment for a service under the relevant offer and not a donation.

2.4. A donation is not the purchase of a share in the Organization and does not give a right to profit, ownership, or participation in governance.

3. Purpose of a donation

3.1. A Donor may direct a donation to the Organization’s general activity or to a defined area: access to educational programs for those who cannot pay for participation; open events and materials; research and standards; or the capacity of the laboratory.

3.2. The purpose is stated in the payment details or agreed in writing. If no purpose is stated, the Organization uses the donation for its statutory activity at its discretion.

3.3. If it is impossible to use a targeted donation for its purpose, the Organization offers the Donor to agree on another purpose or to return the funds.

4. How a donation is accepted

4.1. A donation is deemed accepted when the funds are received in the Organization’s account. By making a transfer, the Donor confirms that they have read these Terms and agree to them (Article 642 of the Civil Code of Ukraine).

4.2. The Donor decides the amount and frequency of a donation. Automatic recurring charges are made only with the Donor’s separate consent, which the Donor may withdraw at any time.

4.3. The Organization has the right to decline a donation or return it, including where the source of funds cannot be confirmed, the payment arrived in breach of the legislation on financial monitoring or sanctions, or accepting the donation conflicts with the purpose and reputation of the Organization.

4.4. Funds transferred by mistake are returned to the Donor on their written request after verification.

5. Independence of research

5.1. Support does not buy a favorable research conclusion, access to participants’ data, or the right to influence research results, methods, publications, or decisions of the Organization.

5.2. The Organization may publish results regardless of whether they confirm the Donor’s expectations.

5.3. The Donor does not receive access to personal data of participants of programs, pilots, or services.

6. Reporting and public mention

6.1. The Organization reports on the use of donations in accordance with the law and publishes information about its activity within the limits set by law and the statute. For targeted donations the procedure and form of the report are agreed with the Donor.

6.2. A public mention of the Donor is possible only with the Donor’s separate written consent. Such consent is not a condition of a donation, and the Donor may withdraw it for the future.

6.3. A Donor who does not wish to disclose their name may donate anonymously within the limits allowed by law.

7. The Donor’s personal data

7.1. The Organization processes the Donor’s personal data (name, contact details, payment information) to accept the donation, keep records, report, and meet legal requirements in accordance with the Privacy Notice.

7.2. Payment data is also processed by the selected payment service under its own policy.

8. Tax consequences

8.1. The tax consequences of a donation for the Donor are determined by law and the Donor’s status. The Organization does not provide tax advice and recommends that the Donor consult a specialist where needed.

8.2. The Organization is listed in the Register of non-profit institutions and organizations. This alone does not mean that the Donor is entitled to any benefits.

9. Final provisions

9.1. The Organization may change these Terms. A new edition applies to donations made after its publication.

9.2. Disputes are resolved through negotiations and, if no agreement is reached, by the court at the Organization’s location. The law of Ukraine applies.

9.3. Requests are sent to [email protected].

9.4. This document is made in Ukrainian. The English translation is provided for convenience; in case of discrepancies the Ukrainian text prevails.
